U.S. Sentencing Commission’s Ruling May Let Crack Dealers Out Early

Just after the U.S. Supreme Court ruled (7-2) Monday that federal judges can use their discretion when giving shorter prison sentences in order to reduce the disparity between crack and powder cocaine, the U.S. Sentencing Commission (USSC) decided today (Dec 12) to make the new sentencing laws retroactive.


Street pharmacists and social activists have been reporting racial injustice since 1986 and 1988 when a federal sentencing law created a 100:1 ratio between crack and powder cocaine in order to activate certain mandatory minimum sentences for dealing and possession.


Federal law required a crack dealer (mostly African Americans) to serve a minimum of five years in prison for selling 5 grams of crack cocaine while a powder cocaine dealer would have to sell 500 grams to trigger the same sentence.


As of November 1, first-time offenders caught with 5 grams of crack cocaine will receive 51 to 63 months, whereas the old law mandated 63 to 78 months and first-time offenders possessing 50 grams now get 97 to 121 months, down from 121 to 151 months.


According to the Commission, approximately 86 percent of inmates affected by the new law are black, 94 percent are men. The Commission’s decision to make the new law retroactive affects almost 19,500 prisoners.


The mandatory crack cocaine sentencing laws were created based upon what the Sentencing Project believes was sensationalized portrayals of crack, stating that it is a violence-inducing drug that was 50 times more addictive. The Sentencing Project reports, in fact, that the physiological effects of all types of cocaine are the same.


The American Civil Liberties Union (ACLU) says that thousands of offenders who were harshly sentenced can now have their case reviewed in court. Jesselyn McCurdy, legislative counsel for the ACLU Washington Legislative Office, said that the USSC’s decision “to apply the guidelines retroactively means justice for offenders sentenced under the previous guidelines, who may no longer have to serve more time than required by law.”


The Supreme Court’s ruling in Kimbrough v. U.S, which centered around Derrick Kimbrough’s 15-year sentence for distributing 50 grams of crack cocaine when the sentencing guidelines mandated 19-22 year, showed that judges can disagree with the 100 to 1 disparity between crack and powder cocaine by sentencing offenders below the guidelines.

The manager of superstar rapper Plies was arrested yesterday (December 11), after seized over 80 pounds of cocaine in Tampa, Florida.Police seized the cocaine from David Lee Gay Jr. and various associates last night, after another associate was caught selling cocaine to an undercover police officer.Gay, 35, worked for Isabomb Entertainment. According to investigators, he allegedly paid $6,000 for one kilo of cocaine, which equals out to 2.2 pounds.

Police say that Gay and a co-defendant named Eleazar Gutierrez-Castillo conspired to traffic at least six kilos of cocaine from September until November.In addition to recovering the cocaine, police found 10 grams of marijuana, drug paraphernalia, a 9mm Taurus handgun and almost $8,000 in cash in the master bedroom of Gay’s residence. Castillo, who is now cooperating with local police, was arrested after he sold 5 ounces of cocaine to an undercover Tampa police officer on Tuesday (December 11).In addition to Castillo’s testimony, investigators intercepted several phone calls connecting him to the cocaine ring.Police have charged Gay with several federal and state charges, including possession of cocaine, racketeering, armed trafficking and several conspiracy charges.

Gay and Castillo are currently in the Orient Road Jail awaiting a decision with no bail being set as of press time.

Mannie Fresh's Sister Reportedly Murdered In Her New Orleans House

Mannie Fresh's sister, Angela Bryant, was shot and killed Wednesday night in her New Orleans home, according to local TV affiliate WWLTV. Police reportedly said the 42-year-old mother's two young children were present but not physically harmed.

Authorities said Bryant, whose body was discovered early Thursday morning, was murdered between 10 p.m. and midnight, according to WWLTV. Her black 1998 Lexus LS 400 reportedly went missing after the murder.

Bryant's husband, who had been out of town when his wife was killed, arrived at the house before noon and was distraught, according to the WWLTV report. The couple got married last month, and Bryant celebrated her birthday with family on Wednesday night, WWLTV said. Police reportedly did not elaborate on the conditions of the children, ages 2 and 7, but said they were safe and healthy.

"We are still working on the motive of this," New Orleans Police Superintendent Warren Riley told reporters. "We do have some limited information and limited information relative to leads at this time, but it's still very early at this point."

Police said they were not sure if Bryant knew the killer, but they did say that there was no sign of forced entry, according to WWLTV. Forensics swept through Bryant's house on Thursday, and relatives and neighbors also went to the residence.

"We've not drawn any conclusions," Assistant New Orleans Police Superintendent Marlon Defillo told WWLTV. "We've not made any elimination. As the day progresses, we hope to learn more, but it's a work in progress."

Mannie Fresh (real name: Byron O. Thomas) — a legendary producer who claims T.I.'s "Big Things Poppin' " as his latest hit — was reportedly on his way back to his native New Orleans from Texas.

Cash Money Records co-founder Bryan “Birdman” Williams and his brother Ronald “Slim” Williams were arrested in Kingsport, Tenn. on Tuesday evening (November 27) and charged with posession of marijuana. According to the Kingsport Times-News, the brothers were traveling in an RV on Interstate 81 with a group that included Birdman’s wife, and road manager, Shahid Muhammad. A local police corporal stopped the the vehicle after it made an improper lane change and forced a tractor trailer into the emergency lane. When the officer stopped the vehicle, he reportedly smelled marijuana and later found a pound of the substance hidden in a trashcan. A 2-23 carbine assault rifle, a 9mm handgun and a magazine for .45-caliber handgun were also confiscated. Birdman, his wife, Slim and the other 13 people aboard the RV were all arrested and charged with possession of over one half of an ounce of marijuana. The other passengers were all believed to be employees of Cash Money Records. The RV was moved to a secure location in order to allow for a more thorough search. So far, none of the passengers have been charged for the weapons, but the Bureau of Alcohol, Tobacco and Firearms will be assisting with the investigation due to the presence of the assault rifle.

Rhyming for over two minutes straight and seemingly out of nowhere as a cleanup hitter, 'Donna switched from the Stapleton lingo ("1-6-0 4-9-3-11") to the gutter and back. He doesn’t pause for a breath, he’s just relentless. He may not be on top of the overall emcee list, but Cappa’s "Winter Warz" verse is like Sleepy Floyd’s 53 Point NBA Playoff game: An all-time performance from a footnote player.

“Victory”-Puff Daddy & the Family - No Way Out (1997) Notorious B.I.G. 1st verse.



There are so many reasons why this verse is here. The last virtuoso performance of Biggie. The first salvo from a top selling, yet underrated album. Puffy’s suspense building intro combined with Rocky Balboa’s Championship pedigree, and then B.I.G.’s explosive abandonment of the slow flow that made him king. Arguably better than any verse on his last album, the power of the verse can be summed up in one stanza. “Warm nights I perform like Mike/Anyone, Tyson, Jordan, Jackson.” ‘Nuff said. The Streets Disciple was still nasty with no sign of Escobar. Just hearing it evokes a feeling of 40 oz’s, bodega heroes and blunts. Nas’ entry to our lives was full of the power of youth. Rich with imagery ("Shoot slugs from my brain just like a rifle") irreverence ("I went to hell for snuffin' Jesus") and young rage ("Nasty Nas is a rebel to America"), Nas was definitely causing hysteria. While Main Source was NOT forever, and Akinyele went from dropping rhymes to bumping rumps, Mr. Jones would go on to greater heights as arguably the premiere lyricist of his generation. This verse was his entry and calling card.

“The Headbanger”-EPMD - Business Never Personal (1992) Redman Verse



Rough, rugged, and raw. Politically incorrect (clowning cerebral palsy!) hood pop culture referential ("Lullaby your stupid ass - Rockabye baby - shout to Keisha from "New Jack City"), and just flat out bugged, Redman was as raw as it got for a lyricist in his era. The cherry on top of a hardcore chocolate sundae, the cleanup verse was frenetic, comical, violent, and everything about Hip-Hop in that era, complete with the metaphors and similes. Respect is due and this verse keeps collecting.


“The Message”-Grandmaster Flash & The Furious 5 - The Message (1982) Grandmaster Melle Mel 1st Verse.



Post-Civil Rights. Post Disco. Product of Reaganomics. Urban. Gritty. “Broken glass everywhere, people pissing in the corners, yo they just don’t care.” Mel took us from the parties in the club and took it to the mud. Mirroring Stevie Wonder’s abandonment of Berry Gordy-flavored bubble gum, Mel took that disco rap and slammed it in the grime. Yeah, he yearned for the color TV to watch the Sugar Ray fight, but “The Message” was the truth from the mouth of the Grand Master. Not from the Klan, but representing the Clan. The Furious Five. The world would never be the same.


"Puffin on Blunts and Drankin’" Tanqueray-B-Side to Dr. Dre ‘F**k With Dre Day’ Single (1992) Kurupt Verse



It was supposed to be a throwaway record. 7 Minutes which began with Dre poppin off of a G-Funked up "Impeach the President." Nobody told that to the Dogg Pound. With apologies to Rage, who got the rhyme of the month when the bible was still sacred, Kurupt BLACKED OUT! Just relentless mic slaughter with wordplay, delivery, even spelling. It was brutal and unforgettable. It was Kurupt’s message to the East Coast: Death Row was for real on the mic. He edges Rage due to emotion and length, but the female lyrical murderer gets honorable mention for her own lyrical tornado on this.

“Raw”-Big Daddy Kane - Long Live The Kane (1988) 1st. Verse



You got a small taste of him on “Just Rhymin’ With Biz.” Cameo, Afro, Virgo, Domino. Well this verse on "Raw" brought another word virtuoso. Hardcore. That voice, so dominant. If you never saw Kane, you’d think he was 9 feet tall with the force of the terminator. Words were simultaneously smooth and rough. Subtle and powerful. Kane perfected both sides of the spectrum so well that the balancing act was in full effect. You got up and danced…cause Kane said so. The skill to ill and break and take. Long live the Kane.

“Straight Outta Compton”-N.W.A. - Straight Outta Compton (1989) Ice Cube



The shot heard around the world. ”When I’m called off, I got a sawed off, squeeze the trigger and bodies are hauled off.” There were others who were more outlandish, and others who were more authentic, but not many were more convincing. Ice Cube entertained and terrified those who were close enough to see, and enthralled those who were so far away they could only live vicariously through his verse. Down, with a capital CPT. This verse is the reason your parents hate rap music and is the progenitor of mainly everything we argue about concerning the life and death of Hip-Hop.

“The Symphony”-Marley Marl - In Control, Vol 1 (1988) (Kool G. Rap Verse)



Batting cleanup on a song with the Kane wasn’t easy but the Kool Genius delivered what many hail as the greatest verse of all time. Twice as horrifying as Vincent Price, D-evil (Before Hov) in a spell of a sleep, and while he’s counting his money you count sheep (Sleeping). It was verbal assault in its purest form. You couldn’t replace him , ice him or ace him. Base him face him slice him or race him. Indestructible on the microphone and rumors say he initially rhymed the verse until the tape reel popped. G rapped for so long the video had to cut a portion of his verse. The only rapper to have ever rendered Kane in his prime as anti-climactic on a track.


“Beast From The East”-The Lost Boyz - Love, Peace, & Happiness (1997) Canibus Verse



From nowhere, newcomer Canibus destroyed this track like the Knicks destroy the dreams of their fans. Even with a dope Redman verse, you don’t remember anything from this song but lyrical devastation. The fire in his voice. The raw lyricism. It was almost like the next stage of evolution. “I existed, in the Garden of Eden getting’ lifted, sticking d**k to Eve before she was Adam’s mistress.” All you could do was cover your mouth and go “Ohh, did you hear that!” 50 bucks says we can tell you exactly where your tape popped. Thank God for CDs.

“Triumph”-Wu-Tang Clan - Wu-Tang Forever (1997) Inspectah Deck Verse



Rhyming over the drums of war and blanketed by string instruments, Deck heralded the triumphant return of the Clan, passionately referencing Socrates, atomic bombs, forensic science and just about everything but the kitchen sink. On a double album with 8 other emcees with different styles, The Inspectah Deck had perhaps the most memorable verse of them all.


“U Don’t Know”-Jay-Z - The Blueprint (2001) 1st Verse



No more admiring the Jiggaman “from 4 fiends away,” The Blueprint represented Jay-Z’ s first real attempt to let us in. Even in an attempt to be more soulful, Marcy’s finest showed he’s at his best when he’s bringing the grit and the game at the same time. “U Don’t Know” is almost “Where I’m From” part 2, but with more passion and more force. Just Blaze on the boards gives Jay just enough fuel to blast off about the place where the hood’s swallowing (pause) and there’s so much coke that you can run slalom. Even when talking on the hood, Jigga throws in something like skiing to show he wasn’t your average hustler. Now you know.


“Time’s Up”-O.C. - Word…Life (1994) 1st Verse



The first call to arms of the Keep It Real Brigade. Previously seen batting clean-up on Organized Konfusion’s “Fudge Pudge,”O.C gives a stern warning to “those who pose lyrical but really ain’t true,” delivering a caveat to posers and rappers who present themselves as gangsters and thugs when their actual lives deviate from their rhymes. While skilled, O.C.’s career wasn’t been mainstream, but he spearheaded the underground vanguard and put fakers on notice: their time was up!

“Lyrics of Fury”-Eric B & Rakim - Follow The Leader (1988) 2nd Verse


He’s got more classic songs, and he’s definitely got more popular songs to reference, but the original god mc rarely showcased lightning fast mic crushing flow such as he represented on Lyrics of Fury. “Funky Drummer” powered, guitar enhanced, no hooks or funny business. Rakim switches flows, and rhyme schemes effortlessly with a punishing array of line after line. The second verse gets the nod over the other two for the energy, the pace, and “capable, breaks the unbreakable series that leaves you breathless. You don’t have time to clap to this. Just listen and let the rhythm hit you.

“Respiration”-Black Star - Black Star (1998) Mos Def Verse



B-Boy intro and melancholy beat segue into a robust Mos Def delivering his version of “The Message”. No longer Reaganomics, but the post Bush, Clinton era America highlighted by Giuliani dystopia masquerading as Disneyfied New York. Mos describes a Rotten Apple encapsulated by higher costs of living, a stock market tempting brokers towards dishonesty, and evening news casting urban as villain, and overall the everyman’s attempt to sift through the garbage and survive. The city was alive and breathing and Mos Def had his finger on the pulse.

“Dream Shatterer” - Big Pun - Capital Punishment (1998) 1st verse


“It’s Big Pun, the one and only son of Tony Montana, you ain’t promised manana in the rotten manzana.” So true in light of Pun tragically passing away due to complications of his massive gerth. Providing gargantuan lyrics every time he touched a mic, Pun was the beacon for Latinos in Hip-Hop who for too long were relegated to second string status in the rap game. The Boricua’s flow stole many a show [“Off The Books,” “Banned From TV,” et. al] but on “Dream Shatterer” he’s going for self, asserting skills knows no color in the process: “I’m the first Latin rapper to baffle your soul, master the flow, n***as be swearing I’m blacker than coal.”


“Elevators (Me & You)” – OutKast - ATLiens (1996) Andre 3000’s 2nd verse



Mr. Three Stacks was already flowing something crazy since he and Big Boi laid that Southernplayalistic music for your trunk. There is nothing too outerworldy about the track or the flow, but the beauty is in the simplicity of it all. Illustrating his position as a layman that has a superior rap ability with tongue and cheek chutzpah, [“True I got more fans than the average man but not enough to loot to last me/To the end of the week I live by the beat like you live check to check, if it don’t move your feet then I don’t eat, so we like neck and neck”], his job security is since no longer an issue.

“Born Killer” – Scarface - Mr. Scarface Is Back (1991) 2nd Verse


For the budding psychotic, Scarface provided the soundtrack of a lifetime. For the uninformed, he offered a glimpse in to the mind of a man tettering on the edge of insanity. Combine that with one Brad Jordan’s penchant for being one of the South’s finest and you have a verse for the ages. “My momma did her part / But it ain't her fault that I was born with out a heart / In other words I'm heartless duke / I don't love me, how the f**k I'mma love you?” With lyrics like these and a bar none mentality Mr. Scarface received a universal ghetto pass.


“Renegade”-Jay-Z - The Blueprint (2001) Eminem 1st verse


Absent the antics. Minus the mom mashing. No Hailey in sight, Mr Mathers' lyrical gymnastics outshined S. Dot’s verse over the melody of the beat he himself created. The verse that made Eminem all good in the hood on a critically acclaimed album, and gave a true blueprint on how to flow yet deliver a message. Dropping with the bassline and rising with the background strings, then breaking the pattern for onomatopoeia, Mr. Kiss My Ass was certainly the Renegade on this joint.

The Real Thing is Jill Scotts latest studio album. I just recently acquired this album and it is amazing, from beginning to end it is a very solid souful record. She touches on so many genres from her style of rock n roll to blues to neo soul, pop and hip hop. The production on this is outstanding, I'm not sure who it is but it is some serious shit. Since Ive copped this its strictly been on blastmode in my speakers. If you dont have this you need to cop it right now!!! I am absolutely in love with Jill Scott. Her voice puts me to sleep every night.

James Watson, a Nobel Prize winner for his part in discovering the structure of DNA, has provoked outrage with his comments, made ahead of his arrival in Britain today.

More fierce criticism of the eminent scientist is expected as he embarks on a number of engagements to promote a new book ‘Avoid Boring People: Lessons from a Life in Science’. Among his first commitments is a speech to a London audience at the Science Museum on Friday. The event is sold out.

Dr Watson, who runs one of America’s leading scientific research institutions, made the controversial remarks in an interview in The Sunday Times.

Rapper T.I. was arrested in Atlanta yesterday [October 13] by agents of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) after he allegedly attempted to purchase three machine guns and two silencers from an undercover agent, acting as an arms dealer.

In addition to the three machine guns found in his College Park home, police also recovered six additional firearms from a closet in the rapper's house.

T.I. has been charged with felony possession of unregistered machine guns and silencers and possession of firearms by a convicted felon.

According to U.S. Attorney David E. Nahmias, T.I. allegedly sought to purchase an unregistered machine gun, as well as numerous other weapons.

T.I. allegedly paid almost a total of $21,000 in cash to his bodyguard to purchase over 25 firearms on his behalf.

The bodyguard, who was acting as a cooperating witness, told agents that he was purchasing the machine guns on T.I.'s behalf because the rapper is a convicted felon.

The man, who had been employed since July 2007, allegedly purchased nine weapons for the rapper as well as one weapon on behalf of another, unnamed individual.

The bodyguard purchased a total of nine weapons for T.I. and 17 for others on behalf of T. I., because of his prior felony conviction, which prevents him from legally owning firearms.

"Machine guns pose a serious danger to the community, which is why they are so carefully regulated," said David E. Nahmias, United States Attorney for the Northern District of Georgia. "The last place machine guns should be is in the hands of a convicted felon, who cannot legally possess any kind of firearm. This convicted felon allegedly was trying to add several machine guns to an already large and entirely illegal arsenal of guns. Thanks to the good and quick work of ATF, he is now in custody and his firearms have been seized."

The bodyguard, acting as a Confidential Witness [CW] placed a series of phone calls to T.I., which were recorded by the ATF.

The CW called T.I. and said "he had everything," referring to machine guns he was allegedly supposed to purchase on behalf of the rapper.

On October 12, T.I. called the CW and ordered him to deliver the weapons yesterday [October 13].


"This investigation developed very quickly," said Vanessa McLemore, Special Agent in Charge of ATF's Atlanta Division. "We learned only this Wednesday that the cooperating witness was allegedly buying the machine guns for Harris. The cooperating witness told Harris on Thursday that he had obtained the items, and on Friday Harris made it clear that he wanted them delivered to him today. Harris then agreed to meet and took possession of the machine guns this afternoon. He now faces serious federal charges and a potentially long prison sentence."

T.I. will remain in federal custody until Monday, October 15, when he will appear before US Magistrate Judge Alan J. Baverman at the United States Courthouse in Atlanta.

Lookie here, y’all. Big Daddy Kane IS the blueprint of so many rappers, I don’t even need to start the list. Being a legend is a full-time job and BDK clocks in with the Hip-Hop Honors tour, along with Skillz, The Roots and MC Lyte. Now, I didn’t know this, but the concept of the tour is The Roots and company perform old school Hip-Hop songs to the glee of the crowd. Anyway, the crew had a date in Philly last night and I heard after the Big Daddy Kane set – it was so dope – the crowd started screaming, “We’re not worthy.” I heard that they said it so much that Kane got emotional and dropped a tear or two from all the love the crowd gave him. From what I heard, after the crowd said, “We’re not worthy” for three minutes straight, Kane spoke.


He said to them (something like this), “All I ever wanted to be was considered one of the best and be respected by my peers in the 80’s. Never in my life, did I think that 22 years later y’all would show me that same love. There are kids here that weren’t even born then and know my lyrics word for word.” I heard Kane apologized for getting emotional and said “This is all an MC can really ask for and this means a lot.”

James Brown's Estate Gets Robbed



Is it hard to rest in peace after living a long life? Apparently so if you’re James Brown. Months after finally being buried, drama continues to invade the afterlife of the Godfather of Soul, as a former trustee is under the microscope for misappropriating $7 million of the singer’s money.

The discovery was made after special administrators to the estate informed a Judge Monday (Sept. 24) of the trustee’s misappropriation. As a result, state circuit Judge Jack Early ordered David Cannon, the ex-trustee to pay $370,000 back to the estate, on top of $350,000 he repaid last month.

The Associated Press reports that Early gave Cannon 10 days to repay the additional $370,000 and 20 days to pay $30,000 for attorney fees and to produce other documents.

Louis Levenson, an attorney for several of Brown’s adult children and grandchildren, mentioned that other trustees for the Brown estate also mishandled late singer’s money, and that his clients are trying to remove all three trustees and have special administrators appointed to handle the estate.

In the meantime, James is rolling over and doing splits in his grave from not being able to pimp slap the people who are supposed to be handling his business.
